Abstract
This article is the result of a dissertation presented to the Army Command and General Staff School in 2008, entitled “International Humanitarian Law and Ethical Military Planning: the jus in bello in the commander's decision as a legitimacy factor for the application of violence by the nation state. " In that research, the role that International Humanitarian Law (IHL) - also known as International Law of Armed Conflict (TIP) - was to play during the military decision-making process, regarding the ethical conduct of an armed conflict. The following are covered. two of the topics that supported the conclusions of this paper.
