A REINTEGRAÇÃO JUDICIAL DE EX-MILITARES SEM ESTABILIDADE E AS CONSEQUÊNCIAS PARA A GESTÃO DO PESSOAL NO EXÉRCITO BRASILEIRO

Abstract

The present work sought to present an analysis on the impact of judicial reintegrations on the management of personnel in the Brazilian Army (EB). Its purpose is to warn about the need to have a standard procedure on the measures to be taken regarding the military reintegrated judicially to carry out health care, in addition to demonstrating through the collected data, the current situation Of the subject researched here in terms of quantitative judicial reintegrations, as the magistrates of the Federal courts have decided on the subject, what jurisprudence has defined and what actions adopted by the Military Area Command (C Mil a) and regions Military (MRI). To this end, this dissertation was developed, from July, through a bibliographic and descriptive research using, also, the resource of structured interviews with unit commanders and support advisors for subjects Legal, questionnaires for the heads of 1st section and for military personnel in the
health area (medical officers). The concern of seeking an improvement and centralization in the measures to be adopted by the OM with a publication through a central organ of the institution that manages human resources, being
the suggestion of the research the General Department of Personnel (DGP), will allow a standardization and better management of these cases. In conclusion, the ideas expressed throughout the work are ratified, emphasizing the importance of the publication of a general procedure linking all Military Area Command and Military Region but does not exhaust the freedom of these great commands to regulate in more detail on the Subject
